Primary Purpose
We are looking for a leader to join ADUSA's Legal team who is passionate about data privacy and security and using data to create personalized customer experiences in a compliant way.
The primary purpose of this position is to provide legal and strategic advice in the areas of data privacy and security to business partners and leaders at Ahold Delhaize USA Services, LLC and its affiliated companies in the United States (collectively the "Companies"). The Companies include two service companies and five grocery and pharmacy retailers (Food Lion, The GIANT Company, Giant Food, Hannaford, and Stop & Shop), located in 18 states and the District of Columbia.
Reporting to the Vice President, Deputy General Counsel for Litigation, Regulatory & Omnichannel Services, who also serves as the U.S. Privacy Officer, the Associate General Counsel will partner with ADUSA's marketing, adtech, retail media, data analytics, digital, and technology teams, among others. Additionally, the Associate General Counsel will partner with global colleagues on various initiatives and will support the global information security organization.
Our flexible/ hybrid work schedule includes 3 in-person days at one of our core locations and 2 remote days. Our core office locations include Salisbury, NC , Chicago, IL, Quincy, MA, Carlisle, PA, Scarborough, ME, Hyattsville, MD and Mauldin, SC. (Bold and Italics, check locations align with manager)

Duties and Responsibilities
- Monitor current and emerging data privacy laws and translate legal requirements into proactive guidance for the business. Partner with ADUSA's Government Relations team to provide input on proposed legislation, potential impacts on the business, and implementation issues.
- Provide strategic legal advice and practical solutions to business partners on a wide range of data privacy topics, including data collection, use, sharing, and security.
- Develop strategies in partnership with the business that maximize the use of data while maintaining compliance with applicable data privacy and security laws and industry practices.
- Collaborate with business partners to identify specific privacy and security risks in product, service, and system development and provide risk-mitigation guidance, including advising on privacy by design and completing privacy impact and risk assessments.
- Effectively communicate ADUSA's commitment to data privacy and security compliance to a broad range of stakeholders through metrics and key performance indicators (KPIs).
- Oversee the maintenance of internal and external privacy policies, customer resources, data processing inventories, privacy impact assessments, and incident response plans.
- Assist the contracting team in drafting, maintaining, and negotiating data protection and vendor information security agreements.
- Support cross-functional compliance with emerging AI regulations and internal governance.
- Provide legal guidance to the Ahold Delhaize Group Information Security team regarding cybercrisis planning and during investigations to ensure they are completed and documented appropriately to minimize risk and fulfill the Companies' legal obligations.
- Support collaboration with the Ahold Delhaize Group Information Security team to align privacy and cybersecurity efforts, including outreach and compliance requirements, to ensure a complementary approach to data privacy and security.
- Develop resources and training materials to educate business partners about legal developments regarding data privacy, information security, and AI.
- Provide supervision (direct or indirect), development, and mentorship of a team of attorneys, specialists, and paralegals supporting data privacy and security compliance.
Qualifications
- J.D. degree from an accredited law school
- State bar license, as a member in good standing, eligible to practice as an in-house attorney
- 14+ years relevant experience practicing law, with a deep understanding of U.S. privacy and security laws and experience in implementing and supporting legal compliance through cross-functional collaboration
- 3+ years in a leadership role
- Expertise in privacy compliance in the marketing, adtech, retail media, data analytics, digital, and technology areas
- Familiarity with NIST security and privacy frameworks and industry best practices, including maintaining policies, procedures, and controls to safeguard personal information
- Experience in managing and overseeing responses to data security incidents, including assessing the risk of harm and determining legal obligations arising from such incidents
- Pragmatic, service-oriented lawyer with well-developed ability and passion for making complex topics understandable for various audiences
- Confidence and flexibility to operate in a fast-paced, rapidly changing environment
- A team player who works collaboratively and builds strong relationships with internal business partners and legal colleagues
- A self-starter who works well with minimal supervision but who shows excellent judgment in knowing when to look to manager and teammates for guidance and when to elevate matters appropriately
- Exceptional communication and project management skills
- Excellent analytical and critical-thinking skills with the ability to leverage data to influence decisions and identify risks and opportunities for improvement
Preferred Qualifications
- IAPP certification (CIPP/US, CIPM, AIGP, etc.) preferred but not required
- Familiarity with OneTrust privacy technology preferred
