This position is based out of our Novo Nordisk office in Plainsboro, NJ and follows all Novo Nordisk guidance for remote/in office dedicated time. EST time-zone hours.
The Position
Responsible for providing legal support for privacy operations at Novo Nordisk Inc. (NNI) and other U.S. affiliates. The position will focus on providing privacy counsel to all clients in the U.S. (or globally who seek to perform an activity in the U.S.) on all matters relating to privacy, data protection, data security, and U.S. law and regulations.
Relationships
Reports to Privacy Counsel for U.S. operations on the Market Access, Pricing, and Privacy Law team within the NNI Legal Department. Acts as counsel for NNI's privacy operations and other U.S. affiliates. Collaborates with clients across the company, including colleagues within the NNI Legal Department, NNI Ethics & Compliance, and Novo Nordisk headquarters, as required. May also interact with external partners, vendors, industry associations, and law firms.
Essential Functions

  • Joins a privacy legal team with expert knowledge of federal, state, and international privacy laws and regulations, including the FTC Act, CAN-SPAM, HIPAA/HITECH (and state supplements), comprehensive state privacy laws, biometric laws, laws related to artificial intelligence, medical information privacy laws, and global privacy laws
  • Partners with NA Privacy Office to advise on legal and regulatory privacy obligations applicable to U.S. operations for risk identification and the enhancement and maintenance of the U.S. privacy program, including U.S. privacy notices (cookie, HCP, employee/applicant, state supplemental, consumer health), data subject requests, and associated procedures
  • Supports NA Privacy Office (as needed) related to security incidents/data breaches and related mitigation efforts, including conducting privileged and confidential investigations to determine if a security incident rises to the level of a data breach under applicable U.S. laws, providing other legal advice, and involving outside counsel
  • Responsible for drafting, updating, and negotiating privacy contractual provisions (with the help of the NNI Legal Department Contract Management Team) in agreements with third-party vendors, digital health collaboration partners, healthcare professionals, market research activities, and software-as-a-service (SAAS) providers
  • Actively participate in day-to-day support (through meetings, electronic communications, etc.) with internal clients across U.S. affiliates and global company for any business initiatives, proposals, and/or concepts that involve data in any form to ensure compliance with applicable U.S. privacy laws and regulations
  • Liaise and collaborate with other attorneys in the NNI Legal Department to coordinate legal guidance
  • Collaborate with NA Privacy Office on privacy risk assessments, potential legal impact, and drive solutions
  • May conduct privileged and confidential compliance investigations involving privacy and data protection policy violations
  • Works closely with global organization on new initiatives, streamlining privacy approach, and U.S. privacy risks
  • May advise on existing, new, and emerging technologies, including artificial intelligence and medical devices
  • Liaise with privacy professionals at peer companies and industry organizations
  • Stay informed of laws, regulations, and industry trends, proactively identifying risks, and developing mitigation strategies
  • Assist with the design and implementation of policies, processes, and training as needed
  • May retain, manage, and assist outside counsel as needed
  • Performs other duties as assigned by senior management
  • Provides legal support with moderate oversight and guidance from managing attorney


Physical Requirements
10-20% overnight travel required.
Qualifications

  • A J.D. and state bar admission are required
  • 4+ years of legal experience required; in house experience in privacy/cybersecurity law preferred
  • Experience within the healthcare/pharmaceutical industry preferred though not required
  • In-depth knowledge of applicable federal, state, and international laws relating to privacy, cybersecurity, healthcare, and artificial intelligence preferred
  • Experience with clinical trials and associated research activities preferred but not required
  • Demonstrated experience making sound risk assessments, and identifying and resolving legal and regulatory issues quickly and effectively and ability to make real-time decisions
  • Proven track record as a strong team player with ability to work collaboratively and cross-functionally in a complex organizational structure
  • Ability to work independently, proactively, and be pragmatic and results focused
  • Strong problem-solving skills - demonstrates and exercises creativity and initiative
  • Practical business judgment and ability to qualify actual practical risk
  • Strong written and verbal communications skills - able to effectively collaborate and communicate with other client groups within the company
